Obesity is a condition that is affecting an increasing proportion of the population. There are varying levels of obesity from Obese Class One where a person has a body Mass Index of between 26 and 30; to Moderately Obese (Class Two) at 31 to 40 BMI; and Morbidly Obese (Class Three) of in excess of BMI 40. Research has shown that obesity is often gene related but the same research has shown that the role of genes can be diminished though exercise.

People who are overweight though are often put off in attempting to undertaking exercise because of the difficulty often involved in some forms of exercise. There are though a number of simple exercises that anyone should be able to undertake to lose weight:

Stretching Exercises - Stretching exercises are good for warming up and cooling down during periods of exercise.

Neck Stretches - a good place to start is with the neck stretch that simply involves moving the chine slowly down towards your chest and then holding that position for ten seconds before assuming the start position.

Shoulders, Arms and Chest - Whilst standing interlock your fingers and then stretch your arms up into a position above your head. Again hold that position for ten seconds before assuming the start position.

Others - Back Stretches; Hamstring; Buttocks; Abdomens; Thigh; Calf; and Groin

Upper Body Exercises:

Press Ups - Although many people initially do not have the upper body strength required to do full press ups; it is possible to start by providing additional support by kneeling rather than using the toes.

The applicable law in this situation is California Penal Code section 148, which states:

California Penal Code (CPC or PC) section 148
.  “(a) (1) Every person who willfully resists, delays, or obstructs any public officer, peace officer, or an emergency medical technician, as defined in Division 2.5 (commencing with Section 1797) of the Health and Safety
Code
, in the discharge or attempt to discharge any duty of his or her office or employment, when no other punishment is prescribed, shall be punished by a fine not exceeding one thousand dollars ($1,000), or by imprisonment in a county jail not to exceed one year, or by both that fine and imprisonment.”

Under the law, every person who willfully resists, delays, or obstructs any public officer, peace officer, or emergency medical technician, in performing his/her duties, shall be punished by a fine of up to $1,000, or up to one year in a county jail, or both, if charged as a misdemeanor.  If “great bodily injury” occurs to a police officer, then the case can be charged as a felony, making the maximum go up substantially – to three years in prison and a fine of over $2,000.00.

Many of these cases involve a police officer's word against a suspect's word. In these instances, defense attorneys will want to conduct a "Pitchess Motion" to see the entire personnel and complaint history of the officer. It may turn out that the officer has been accused in the past of excessive force and making false accusations against suspects. If so, the defense can use this to challenge the officer's credibility, and often get the resisting arrest case reduced or dismissed.

In the experience of this author, what helps most is bringing in additional evidence that is not in the police report.  That could be videos, witness testimony, or the work produced by an investigator.

Prosecutors generally are tough on these cases, as they want to be seen as tough on crimes against the police.  However, by presenting them with facts that contradict the police report, and call into question the truthfulness of the police officers, these cases can often be reduced, dismissed, or otherwise defended.
